THE FIRST DEALS WITH A GAS AND WATER DEPARTMENT ISSUE.

THERE'S A LOT WITHIN THAT RESOLUTION AND I'VE ASKED MARK RIGGI IN S TO COME AND GIVE US A BIT OF HISTORY ON THAT.

IN ORDER TO GET IT BEFORE US I NEED A MOTION AND A SECOND.

>> THANK YOU. GOOD AFTERNOON MAYOR AND COUNCILPERSONS, MARK RIGGINS. A BRIEF HISTORY OF THE RELATIONSHIP BETWEEN EFFORT CAMPBELL AND MY DEPARTMENT.

THE CITY OF CLARKSVILLE, GAS AND WATER, HAS TWO CONTRACTS WITH EFFORT CAMPBELL, ONE OF THOSE FOR GAS SALES.

IT STARTED OUT GAS SALES AND IT'S TRANSPORTATION OF GAS.

THE OTHER BEING THE STAFFING AND RUNNING THE GAS SYSTEM ON EFFORT CAMPBELL. THIS CONTRACT OR REVISION TO THE CONTRACT CONCERNS THE TRANSPORTATION PORTION OF THAT SO INITIALLY CLARKSVILLE ENTERED INTO AN AGREEMENT WITH EFFORT CAMELBACK IN I BELIEVE IT WAS 1958 FOR DIRECT GAS SALES.

WE SOLD EFFORT CAMPBELL ALL OF THEIR NATURAL GAS.

I BELIEVE NOVEMBER OF 2011 EFFORT CAMPBELL STARTED ENTERING INTO AGREEMENTS WITH -- THEY STARTED PURCHASING THEIR GAS DIRECTLY FROM TENNESSEE GAS PIPELINE AND THEY WOULD TRANSPORT THE GAS THROUGH OUR INFRASTRUCTURE TO THE FORT CAMPBELL GATE. THEY STARTED ROUGHLY 2011.

WE DIDN'T HAVE A TRANSPORTATION AGREEMENT WITH FORT CAMPBELL.

IT WAS SOMETHING THAT WAS ONGOING.

I'M NOT CERTAIN WHY OR HOW THAT HAPPENED OR WENT ON SO LONG.

IT STARTED TO A DOWNWARD DECLINE OR ROCKY RELATIONSHIP BETWEEN MY DEPARTMENT AND FORT CAMPBELL. IT GOT OFF KILTER MORE AND OTHER AND PERHAPS A LARGE FAULT OF OUR OWN.

THAT BEING SAID THE CITY AND FORT CAMPBELL ENTERED INTO A CONTRACT ROUGHLY TWO YEARS AGO FOR THE TRANSPORTATION OF SUCH, FERN TRANSPORTATION AND WHAT THAT IS, MOST CUSTOMERS ARE DIRECT SALES CUSTOMERS, AS ANY OF YOU, IF YOU HAVE GAS AT YOUR HOME, I WORRY ABOUT EVERYTHING IT TAKES GETTING THAT GAS FROM THE GULF OR UP NORTH NOW WHERE IT'S COMING FROM TO YOUR HOME.

THAT'S WHAT YOU PAY ME FOR, TO GET THAT THERE.

TRANSPORTATION CUSTOMERS, WHAT THEY DO IS THEY PURCHASE THAT GAS DIRECTLY FROM THE SAME FOLKS THAT I DO OR OTHERS AND THEN WE HAVE A CONTRACT WITH THEM TO TRANSPORT THAT GAS FROM OUR GATE STATION WHICH IS ROUGHLY RELATIVE TO EXIT 31 ON I-24 BUT IT'S ON 41A TO PIPE THAT DOWN FROM THE PIPELINE TO WHERE EVER THEIR SERVICES ARE. USUALLY IT IS AN INDUSTRIAL OR ANOTHER GOVERNMENT ENTITY. SOMETHING LARGE LIKE THAT.

WE HAVE TWO DIFFERENT TYPES OF TRANSPORTATIONS, AND ALL BUT THIS ONE ARE INTERRUPTIBLE. THE REASON BEING, THOSE BUSINESSES, THEY GET A BETTER RATE BECAUSE AT SOME POINT AS YOU CAN IMAGINE THIS TIME OF YEAR WHERE IT'S COLD A LOT OF GAS DEMAND, IF SOMETHING WAS TO HAPPEN TO ONE OF THOSE PIPELINES AND IT CAUSES, YOU KNOW, SOME TYPE OF RESTRICTION ON MY SERVICE WE HAVE AGREEMENTS WITH THOSE INDUSTRIAL CUSTOMERS THAT IN THOSE CASES WE CAN NOTIFY THEM WITHIN A CERTAIN AMOUNT OF TIME AND I CAN ACTUALLY CURTAIL OR SHUT OFF THEIR GAS USAGE.

THEY'VE AGREED TO HAVE SOME SORT OF OTHER FUEL OR SOMETHING LIKE THAT FOR PROCESS OR TO JUST CLOSE DOWN.

AND AGAIN THEY GET A BETTER RATE FOR THOSE.

THE CUSTOMERS, IN THE INDUSTRY, THEY HAVE THE CAPABILITY.

THEY KNOW HOW MANY WIDGETS THEY ARE BUILDING TOMORROW AND THEY KNOW HOW MANY UNITS OF GAS IT TAKES TO BUILD THOSE SO THEY COMPUTER -- THEY COMPUTER NATE HOW MUCH GAS IT WILL TAKE FOR EACH DAY. FOR THOSE FOLKS WHO NEED GAS ALL THE TIME, FORT CAMPBELL IS THE ONLY FIRM TRANSPORTATION CUSTOMER NOW. THE REASON BEING, FORT CAMPBELL, WE HAVE 30-SOMETHING THOUSAND TRIPES THAT LIVE ON POST I BELIEVE IT IS THAT A LOT OF THOSE HAVE HEAT.

IT'S USED FOR COOKING AND FOR -- THE GAS IS USED FOR COOKING AND HEAT, ENERGY PLANTS, THINGS LIKE THAT AND WE CAN'T VERY WELL CURTAIL OR SHUT OFF THEIR GAS IN THAT SITUATION SO THEY PAY A DIFFERENT RATE, A HIGHER RATE IN ORDER TO HAVE THAT GAS ALL THE TIME BUT THEY STILL WANT THE ABILITY TO PURCHASE THAT GAS FROM THAT -- THE SAME PERSON I DO, THAT RETAILER, TO DISTRIBUTOR, DIRECTLY TO THEM. AGAIN, WE ENTERED INTO THIS CONTRACT ROUGHLY TWO YEARS AGO. I'M HAPPY TO SAY THAT WITHIN THE LAST TWO YEARS THAT THAT RELATIONSHIP HAS STARTED GETTING BETTER OVER THE COURSE OF TIME AND AT ONE POINT I'LL SAY THAT BECAUSE OF DIFFERENCES, LACK OF DOCUMENTATION AND REPORTS OR RECEIPTS, WHATEVER IT MAY BE, AT ONE POINT THERE WAS AN OUTSTANDING BALANCE THAT WE SHOWED THAT FORT CAMPBELL OWED US OF ALMOST $500,000. I REPORT THAT WITHIN THE LAST TWO YEARS WE ARE AT A ZERO BALANCE WITH FORT CAMPBELL AND WITH THE PASSING OF THIS RESOLUTION, THIS FINALLY CREATES PEACE BETWEEN FORT CAMPBELL AND CLARKSVILLE GAS & WATER, I'M PLEASED TO ANNOUNCE. IT'S BEEN A LOT OF HARD WORK ON FORT CAMPBELL AND THE LEGAL TEAM AND A LOT OF HARD WORK FROM MY STAFF SO VERY PLEASED IN THAT. THE MAIN CHANGES IN THE AGREEMENT THAT COME WITH THIS, AND YOU'LL SEE THIS AS REPEALING A PREVIOUS RESOLUTION AND IN REPLACING IT WITH THIS ONE.

THE MAIN CHANGES IN THAT, IN ORDER TO BE A FIRM TRANSPORTATION CUSTOMER THERE'S A MAXIMUM QUANTITY OF GAS THAT THEY'RE ALLOWED TO GET UP TO THAT POINT.

ANYTHING ABOVE THAT I HAVE THE ABILITY IN THOSE SITUATIONS I WAS DESCRIBING EARLIER TO SHUT THEM OFF.

AS YOU CAN IMAGINE TRYING TO PLAN FOR ALL OF OUR CUSTOMERS I CAN'T ALLOW JUST EVERY CUSTOMER TO USE ALL THE GAS THEY WANT TO USE AND NOT LEAVE ANY FOR ANYBODY ELSE.

THAT AMOUNT, WE HAVE AGREED, AND IT COMES FROM AVERAGES OVER THE LAST THREE YEARS. THE CHANGE IS IT WAS UNCLEAR IN

THE EXISTING RESOLUTION AND SUBSEQUENT CONTRACT THAT BOTH PARTIES HAD TO AGREE TO A CHANGE IN THAT NDQ, OR MAXIMUM DAILY QUANTITY. IN THIS ONE YOU'LL SEE THE REVISED REQUEST CHANGE NTQ, THAT THE CONTRACTOR, WHICH IS ME, HAS TO CONFIRM OR DENY THAT REQUEST. THAT'S A BIG DEFENDANT IN THE GAS COMPANY. WE WANTED THAT AND THEY WERE HAPPY TO OFFER IT. WE RADIO REVIEW THIS CONTRACT EVERY YEAR AND THERE MAY BE MINOR CHANGES THAT WILL COME BEFORE YOU IN THE FUTURE BUT I BELIEVE WE HAVE THE LION'S SHARE HERE. ANOTHER THING IT ALLOWS FOR THEM TO DO, BY A CERTAIN POINT EVERY DAY THEY HAVE TO TALK TO TENNESSEE GAS PIPELINE AND TELL THEM, I WANT THIS MUCH GAS.

ANYTHING WITHIN THAT MDQ AMOUNT. AS YOU CAN IMAGINE TRYING TO GUESS HOW MUCH GAS YOU'RE GOING TO USE IN A DAY, I THINK ABOUT THIS WITH ALL THE RESIDENTIAL CUSTOMERS WE HAVE AND COMMERCIAL, I DON'T KNOW WHEN YOUR HEAT IS TURNED ON AT YOUR HOME AND I DON'T KNOW HOW MANY PIES THIS PERSON IS COOKING TODAY OR WHATEVER THAT MAY BE SO IT'S HARD FOR ME TO DETERMINE THAT SO I CAN IMAGINE IT'S HARD FOR FORT CAMPBELL WITH THE HEATING AND COOKING AND EVERYTHING THAT YOU CAN IMAGINE THEY HAVE GOING ON OUT THERE. IT'S HARD TO DETERMINE, YOU KNOW, THAT, AND ONCE A DAY, YOU KNOW, JUST TRYING TO GO OFF OF HISTORICAL NUMBERS. ON PAGE 4 OF THE FIRST AGREEMENT YOU HAVE, A CAVEAT, IT ALLOWS THEM THAT ONE OTHER TIME IN THAT DATE TO CHANGE THAT NOMINATION. IT GIVES THEM THE FLEXIBILITY TO TRUE UP THE NUMBER AS MUCH AS POSSIBLE.

WE HAVE NO PROBLEM WITH IT. THE CLOSER THEY ARE TO THE NUMBER, THE BETTER IT IS FOR US AND IT MEANS LESS PENALTIES ON FORT CAMPBELL SIDE WHICH WE ARE FINE WITH.

MY COMPANY, WE'RE NOT DESIGNED OR DO NOT WANT TO BE DESIGNED TO COUNT ON MAKING MONEY OFF OF PENALIZING OTHERS, OUR CUSTOMERS. ONE OF THE OTHER THINGS THIS DOES IS BEFOREHAND OR IN THE CURRENT CONTRACT ANYTHING IN EXCESS OF 10 PERCENT ABOVE OR BELOW WHAT THEY NOMINATED FOR EACH UNIT OF GAS MCF, IT WAS A TEN DOLLARS PENALTY.

THAT'S A LOTS OF MONEY THAT ADDS UP.

WE'VE BEEN TOLD AT ONE TIME THAT SOME OF THESE BILLS A THIRD OF THE BILL THAT FORT CAMPBELL PAYS IS IN PENALTY.

I CAN UNDERSTAND THEIR CAUSE FOR WANTING THIS CHANGED.

THAT'S TEN DOLLARS NCF. ONE OF THE THINGS IT SAID ANYTHING ABOVE 40 PERCENT, WHETHER IT WAS WITHIN THE POLICE DEPARTMENT OR NOT, THAT -- WITHIN THE MDQ OR NOT.

WE'RE GOING TO PLAN FOR FORT CAMPBELL TO HAVE ACCESS TO THAT AMOUNT, WHETHER THEY USE IT OR NOT.

WE'RE NEVER GOING TO DIVE IN AND USE A PORTION OF THEIRS JUST IN CASE. WITH THE CHANGE THEY CAN USE ANYTHING UP TO THAT MDQ WITHOUT THE FEAR OF BEING SHUT OFF WHICH MAKES SENSE BEING A FIRM CUSTOMER.

THE NEXT IN THE HIGHLIGHTS, AGAIN, ANYTHING OVER THAT 10 PERCENT, IT WAS AN NCF CHARGE AND A TEN DOLLARS PENALTY.

ON PAGE 3 OF THAT CONTRACT, EXHIBIT A, IT SHOWS A TRANSPORTATION RATE, AND WE HAVE BASICALLY A TIERED SCALE THERE ZERO TO 10 PERCENT, A 20-CENT CHARGE PER NCF, TEN TO 25, 35 PERCENT. ANYTHING ABOVE 35 IS 50.

ANYTHING ABOVE THAT 40 PERCENT, THAT'S WHEN WE'LL CHARGE THE TEN DOLLARS. .

WITH THEIR ABILITY TO NOMINATE BASED OFF OF HISTORICAL DATA AND THEN ALSO THE ABILITY TO CHANGE THAT ONE MORE TIME DURING THE DAY, WE DON'T THINK THAT THAT WILL EVER -- WE'LL EVER SEE THAT BUT IN CASE YEARS DOWN THE ROAD AND I'M NO LONGER THERE AND THE FOLKS OVER THERE ARE NO LONGER THERE, IF FOR SOME REASON SOMEONE ALLOWS IT TO GET OUT OF WHACK, THAT'S THE TEETH.

THOSE PENALTIES ARE THE TEETH TO CAUSE THEM TO GET BACK IN LINE, IF THAT MAKES SENSE. BEYOND THAT MOST OF THE CHANGES ARE FAR CLAUSES, WE CALL THEM, FEDERAL ACQUISITION COMPLIANCE, AND THEY ARE MANDATES PASSED DOWN FROM THE FEDERAL GOVERNMENT THAT WE COMPLY WITH AND THERE'S NOTHING REALLY OUTSTANDING TO SPEAK OF ON ANY OF THOSE. WE KNOW WHAT THEY ARE AND WE COMPLY WITH ALL OF THEM AND ARE FINE WITH COMPLYING WITH ALL OF THOSE. THE ONLY OTHER THINGS I WILL ADD ABOUT THIS AND THEN I'LL OPEN IT UP FOR QUESTIONS OF COURSE, ON THE CONTRACT, ON THE SECOND VERSION OF THAT IT HAS AN EFFECTIVE DATE OF APRIL 1 AND I'LL ASK WHAT'S THE PROPER WAY TO HANDLE THIS. HOW THAT WORKS WE TRY TO KEEP A PRESSURE OF AROUND -- 350 POUNDS OF PRESSURE IN THESE LINES COMING FROM EXIT 31 ALL THE WAY INTO THE INDUSTRIAL PARK, ALL THE WAY UP TO FORT CAMPBELL BASE, AND AT THOSE POINTS THEY'RE REGULATED DOWN TO A PRESSURE SUITABLE TO GO INTO A SUBDIVISION OR SUITABLE TO GO INTO A BUSINESS AND THEN AGAIN CUT DOWN AT THAT BUSINESS AGAIN SUITABLE TO GO INTO IT OR YOUR HOME. SO WHATEVER GAS IT TAKES THAT WE BRING IN TO KEEP THAT PRESSURE, THAT IS HOW MUCH WE PURCHASE AND AGAIN FOR YOUR USE, HOW MUCH EVER YOU USE WHEN YOU TURN THE KNOB ON THE STOVE OR TURN THE HEAT UP, THAT CREATES THE FLOW IN YOUR METER, MUCH LIKE IT IS IN YOUR HOME.

IT DOESN'T INCLUDE SOME ROUTINE INTERSECTION MAINTENANCE PROJECTS THAT WE DO AS A RESULT OF THE ANNUAL BUDGET THAT WE HAVE EACH YEAR. WE'VE GOT SEVERAL THAT ARE EITHER UNDERWAY OR PLANNED FOR THE CURRENT YEAR, TINY TOWN ROAD AND ALLEN ROAD, AND GLENDALE ROAD AND THE 41A BYPASS.

THERE'S A NEED TO IMPROVE THAT INTERSECTION AS WELL AND THAT'S ON THE DRAWING BOARD AND CLOSE TO BEING IMPLEMENTED THERE AND THEN ANOTHER INTERSECTION THAT'S SEEING EXPLOSIVE GROWTH, FIRE STATION ROAD WITH MLK JUNIOR BOULEVARD.

THAT NEEDS HELP, PARTICULARLY WITH MORE RESIDENTIAL AND -- TIER ONE, HERE'S TIER ONE AS IT WAS.

LET ME CAUTION YOU, THESE PROJECTS ARE LIKELY TO CHANGE BASED ON OUR DISCUSSIONS AS A GROUP AND THEN THE CONSTITUENT'S INPUT INTO WHAT THE PLAN IS. LET ME HIGHLIGHT A COUPLE OF THINGS. YOU NOTICE UNDER RESOURCES, OR SOURCES, IT JUST DOESN'T TALK ABOUT LOCAL MONEY.

BUT GROWTH IS CONTINUING TO HAPPEN.

WE GO TO WHITFIELD ROAD, ANOTHER PROJECT CURRENTLY FUNDED, COMPLETELY FUNDED BY THE COUNCIL IN CURRENT YEAR.

YOU'LL NOTICE THERE'S A STRANGE OBJECT ALMOST IN THE MIDDLE OF THAT AND THAT'S A ROUND-ABOUT, THE FIRST, OR WHAT PEOPLE CALL TRAFFIC CIRCLES IN OUR COMMUNITY.

WE'RE CURRENTLY BUYING RIGHT OF WAY BECAUSE IT'S UNDEVELOPED MOSTLY AND IT'S CHEAPER NOW THAN

IT'S THAT YOU'RE EXISTING THE INTERSTATE ON EXIT 1 GOING WEST INSTEAD OF STOPPING AT THE SIGNAL AND TURN RIGHT, YOU JUST SLIP INTO THE LANE AND TAKE YOU TO TYLER TOWN ROAD.

THIS IS ONE OF THE BEST PROJECTS THAT WOULD QUALIFY FOR STATE AND FEDERAL REIMBURSEMENT. THAT'S WHY THAT IS IN TIER ONE LIST OF PRONGING. SPRING CREEK PARKWAY, KNOWN AS THE NORTHEAST CONNECTOR, THAT WILL TAKE US FROM THE MOST DEFENSIVELY POPULATED RESIDENTIAL AREA OF OUR COMMUNITY, TRENTON ROAD, OVER TO THE MOST DENSELY POPULATED COMMERCIAL DISTRICT IN OUR COMMUNITY WHICH IS THIS BOULEVARD AND CONNECT US OVER TO KROZIER BOULEVARD.

THAT'S AN AMBITIOUS PROPERTY, THREE MILES, AND THAT IS ROUTE THAT WILL CARRY US FROM ONE PART OF TOWN TO ANOTHER.

IT WILL TAKE PARAGRAPH OFF INTERSTATE 24, BELIEVE IT OR NOT, AND IT WILL GET ON TRENTON -- IT'S EASIER THAN GOING THROUGH THE LINE OF TRAFFIC SIGNALS.

WE'RE ENCOURAGED AND EXCITED ABOUT THIS PROJECT AND LOOKING FORWARD TO SEEING THAT HAPPEN TO RELIEVE SOME TRAFFIC BUT IT ALSO GIVES US AN OPPORTUNITY TO OPEN UP SOME MORE FUTURE DEVELOPMENT AND PLAN FOR GROWTH. THEN FUNDING, YOU KNOW, WE GET MONEY FROM VARIOUS TAXES AND FEES AND THAT FUNDS OUR GENERAL FUND AS WELL AS SOME OF THE DEBT FOR THE CAPITAL PROJECTS THAT WE BELIEVE THAT ARE IMPORTANT. AND THEN WE WANT TO LOOK AT REVENUE AND RESOURCES. THIS GIVES-SENSE OF WHAT THOSE ARE, BUT WE HAVE TO BEGIN TO THINK ABOUT COMMITTING THE FINANCIAL RESOURCES NECESSARY IN ORDER TO ACCOMPLISH THIS.

THE LAST ROAD THAT I THINK THE CITY BUILT, NEW ROAD, WAS

NONE OF US WANT TO SIT AROUND AND WAIT FOR ANOTHER 22 YEARS BEFORE WE BUILD ANOTHER ROAD BUT REVENUE IS IMPORTANT AND I CAN TELL YOU THAT IF WE'RE GOING TO BORROW MONEY WHICH IS OUR TYPICAL AND USUAL AND BEST OPTION IN ORDER TO GET IT DONE QUICKER, WE NEED TO GENERATE NEW REVENUE AND AS YOU CAN SEE BY THE SLIDE, IF WE HAVE AN ADDITIONAL $2.4 MILLION IN REVENUE, WE CAN BORROW UP TO $40 MILLION FOR THAT. WHEN THE GENERAL ASSEMBLY PASSED THE IMPROVE ACT WHICH IS TO INCREASE THE GAS TAX, FUEL TAX, THEY GAVE LOCAL GOVERNMENTS THE OPPORTUNITY TO INCREASE THE FUEL TAX IN ORDER TO PAY FOR LOCAL TRANSPORTATION PROJECTS. I CAN TELL YOU THOSE FUEL TAXES ARE FLAT BECAUSE ELECTRIC CARS, MORE ENERGY-EFFICIENT CARS, JUST A LOT OF FACTORS THAT GO INTO THAT.

IT'S A VOLATILE TAX. IF WE WERE TO PUT THAT BEFORE THE PEOPLE WE WOULD HAVE TO HAVE A CAMPAIGN TO TELL THEM WHY WE NEED IT. THE SALES TAX, A VOLATILE TAX, AND ONE GOOD RECESSION WILL CAUSE A PROBLEM.

WE HAD INSULATED DURING THE LAST COUPLE OF RECESSIONS.
