THE KEY CONSIDERATIONS ARE FROM AN ENVIRONMENTAL CONCERN. THE -- I RED IN THE MINUTES THERE WERE NO ENVIRONMENTAL CONCERNS FOR THIS DEVELOPMENT AND ONLY TO MARK THE 100 YEAR FLOOD POINT AND TO GET A GRATING PERMIT. IF YOU LOOK AT THE PROPERTY -- JUST BY ITSELF IT'S JUST A PIECE OF PLAN.

HOWEVER THIS PROPERTY IS ACTUALLY A PARCEL THAT HAS BEEN NOT IN USE. IT ACCEPTS THE DRAINAGE OF 84 ACRES OF ADJACENT PROPERTY. IF YOU CONSIDER THE MAP OF THE AREA OF CLARKSVILLE ALL THE WAY FROM THE CORNER OF RENDELL ROAD TO THE ELEMENTARY SCHOOL. THE ENTIRE MILLS WOOD NEIGHBORHOOD THE NATIONAL GUARD ARMORY, THE ELECTRIC POWER SUBSTATION AND ALL OF MR. KIMBRASL PROPERTY.

ALL OF IT DRAINS IN THIS AREA. THE AREA ITSELF IS LOWER THAN 41 AND HAS BEEN SINCE 41A WAS BUILT ABOUT 70-80 YEARS A GO.

PRIOR TO THAT THE AREA DRAINED TO THE NORTHWEST IN THE CREEK.

SINCE THEN IT'S BEEN BLOCKED. THE DRAINAGE HAS BEEN BLOCKED AND 50 YEARS AGO WHEN THE MILLS WOOD SUBDIVISION WAS DEVELOPED THERE WAS FURTHER EXACERBATED FROM THE RUN OFF FROM THE NEIGHBORHOOD. I DO NOT KNOW IF THE NEIGHBORHOOD WAS PUT IN -- WAS THERE A STORM WATER MANAGEMENT PLAN SEND BY THE COUNTY? IF THERE WAS THEN THIS PARCEL ACCEPTS THAT. ANY DEVELOPMENT WOULD BE A REDEVELOPMENT OF THE MILLS WOOD SUBDIVISION.

CURRENTLY RIGHT NOW UNDER THE MONTGOMERY COUNTY STORM WATER RESOLUTION ANY PART OF LAND THAT IS COMPLETELY SURROUNDED BY A CONTINUOUS CONTOUR AND HAS NO DRAINAGE OUT IS CONSIDERED A SINKHOLE. NEARLY THE ENTIRE PARCEL.

BY THIS DEFINITION IS A SINKHOLE.

THERE IS SOME HIGH GROUND TO THE SOUTHEAST BETWEEN THE LOW FLAT PART OF THE PARCEL AND RING GOLD ELEMENTARY.

CURRENTLY ALL OF THE WATER FROM THE 84 ACRES AND PERHAPS PART OF 41A I'M NOT CERTAIN DRAINS DOWN INTO THIS AREA AND THERE ARE TWO INJECTION WELLS. THAT DIRECT THE WATER IN SUB SURFACE. IN AND AROUND THAT AREA ARE ABOUT TWO TO THREE DOZEN SINKHOLES DEVELOPING.

SOME RANGING FROM AS DR. MURPHY MENTIONED SOME RANGE FROM 10 FEET WIDE AND FIVE FEET DEEP AND THE LARGEST WAS ABOUT 40 FEET WIDE AND 15 FEET DEEP. THEY ARE NOT JUST IN THE LOW AREA. THE SINKHOLES ARE UP THE HILL WITHIN 75-100 FEET ON TOP OF THE HILL ABOVE THE INJECTION WELLS.

THAT TELLS YOU THERE IS QUITE A BIT OF SUB SURFACE ACTIVITY GOING ON AND RESIDENTS HAVE NOTED THERE IS A LOT OF SINKING THAT HAS BEEN GOING ON DURING THE LIFE OF THIS DEVELOPMENT.

NOW MY MAIN CONCERN IS THAT IF THIS WAS TO PROCEED WITH JUST HEY GET A GRATING PERMIT AND GO WITH IT.

THEN YOU STAND THE CHANCE OF PUTTING HUNDREDS OF PEOPLE IN A PIT THAT IS GOING TO EVENTUALLY FLOOD.

I DON'T THINK THE OWNER HAS NOT CAUSED THIS PROBLEM.

THE PROBLEM WAS CAUSED BY THE WAY 41A WAS PUT IN WITH NO SURFACE DRAINAGE FOR THIS AREA. NOW WHAT I THINK WHAT I WOULD LIKE IS THAT BEFORE THIS RESOLUTION GOES FORWARD AND GETS THE APPROVAL IS THAT THE COUNTY OR THE CITY LOOK AT THE GEOLOGY OF THIS PARCEL AND DETERMINE IF IN FACT THERE ARE SINKHOLES THAT NEED TO BE ESTABLISHED AS A WATER QUALITY BUFFER AND THEN SPECIFIC INSTRUCTIONS BE GIVEN TO THE DEVELOPER BEFORE THEY PROCEED AS TO WHAT AREAS SHOULD NOT BE TOUCHED.

AND THE RESOLUTION MENTIONS THAT TREES SHOULD -- THE VEGETATION SHOULD NOT BE REMOVED NOR THE GROUND GRADED.

THERE IS A LOT OF LAND HERE AND SOME OF IT CAN BE USED FOR THIS PURPOSE AND PROBABLY SHOULD BE USED.

HOWEVER I THINK AT THIS POINT INSTEAD OF JUST LEAVING IT UP TO THE DEVELOPER THEMSELVES I THINK THE CITY OR THE COUNTY SHOULD LOOK AT THIS CLOSELY AND DETERMINE IF ANY OF THIS AREA

WHEN THE PROFESSIONAL PARK COMMONS WAS ORIGINALLY DEVELOPED ACROSS FROM THE HOSPITAL THE 01 ZONING WAS USED THINKING THAT IT WOULD BRING DOCTORS OFFICES AND THINGS OF THAT NATURE TO THE AREA WHICH SEEMS LIKE A GOOD OPTION BUT AT THAT TIME THE ZONING ORDINANCE READ DIFFERENTLY AND ALLOWED FOR MULTI-FAMILY ZONING TO BE USED. TOWARD THE BACK OF THE NEIGHBORHOOD WHICH IS A SINGLE FAMILY RESIDENTIAL SUBDIVISION LOTS OF THOSE AREAS EARLY ON WERE DEVELOPED FOR USE AS MULTI-FAMILY. OKAY.

LIKE STONE COURT. BRAND-NEW APARTMENTS BUILT THERE. AND RIGHT THERE ON WHITE FACE DRIVE AND EVEN ON THE OPPOSITE SIDE OF THE ROAD.

AFTER THE ZONING CHANGE THE ZONING ORDINANCE WAS AMENDED WHICH TOOK THAT USE OUT OF 01 IT LEFT SEVERAL PROPERTIES YET IT STILL HAD THESE MULTI-FAMILY DEVELOPMENT AROUND THOSE PROPERTIES. SO WHAT WE'RE DOING HERE IS WE'RE SELLING THIS PROPERTY TO MR. SINGLETARY AND HE INTENDS TO CONTINUE THAT MULTI-FAMILY USE WHICH WILL ACTUALLY BACK UP TO MEADOW WOOD PARK. SINGLE FAMILY SUBDIVISION WHICH I THINK WILL BE A BENEFIT TO THOSE PEOPLE BECAUSE IT WILL ALLOW THE MULTI-FAMILY BUFFER BETWEEN THEM AND THE OTHER COMMERCIAL USES IN THE FRONT PART OF THE NEIGHBORHOOD.

SHE HAD OVER 34 COMPLAINTS ABOUT THE TRASH COMING OVER ON TO HER PROPERTY. WHICH I COME DOWN EVERY WEEKEND TO TAKE CARE OF. THERE ARE THINGS THAT CONCERN ME ABOUT THIS.
